What are the product liability concerns with marijuana?

The laws relating to marijuana are changing constantly at the state level. However, the federal government remains firmly on the side of marijuana being illegal. California was a leader in legalizing marijuana. Not having state and federal laws on the same page has already created issues, but there are other problems that could come up in regards to product liability.

Product liability covers injuries related to the use of the product by the consumer. With marijuana, there are plenty of issues that could come up, according to the National Law Review. Using the product is dangerous without any other problems coming up. While generally, the seller will not be held responsible if someone uses the product and then causes an accident, for example, just the same as someone drinking alcohol, but there are still some issues they could face.

One such issue is the contamination of the product. This could be pesticides used during plant growth or mold on the plants. This is a huge concern that could make people who use the marijuana sick and lead to many product liability claims.

Another huge issue is the sale of edibles, which are the main source for medical marijuana. Most buyers may be unaware of dosage. They may not understand that edibles have a high concentration, making it quite easy to ingest too much. In addition, edibles take longer to have an effect, which could also lead to someone ingesting too much. If sellers do not have proper warnings and dosage labels, they could face liability issues.
